Understanding the process
A permanent contract may be terminated by mutual agreement between a private sector employee and an employer.
This decision to terminate the contract takes the form of a signed mutually agreed termination agreement drawn up in writing which sets out the conditions of the said termination.
Following expiry of the cooling-off period, an application for approval must be submitted to the Labour Inspectorate.
The conditions for applying for approval and for the processing of mutually agreed terminations are set out in the Act no. 1.583 of 2 December 2025 establishing a mutually agreed termination of employment contracts and amending certain provisions of Act no. 1.583 of 2 December 2025 establishing mutually agreed termination of employment contracts and amending certain provisions of Act No. 729 of 16 March 1963 concerning employment contracts, as amended, and Sovereign Ordinance no. 677 of 2 December 1959 on working hours, as amended.

The application for approval of the mutually agreed termination agreement must be submitted to the Labour Inspectorate in duplicate after expiry of the withdrawal period.
You may submit the mutually agreed termination agreement:
- Either by submitting it to the secretariat of the Labour Inspectorate
- Or by registered post with acknowledgement of receipt
