Female employees may not be employed in any night work in factories, on construction sites or in workshops and their outbuildings unless they occupy managerial or technical posts that involve responsibility. Exemptions to this principle may, however, be granted by the Labour Inspector.

Exemptions to this principle may, however, be granted by the Labour Inspector, at the request of the employer, after consultation with the staff representatives, or, if there are no such representatives, with the staff concerned.
Any work undertaken between 10 pm and 5 am is considered night work.
However, a collective agreement may provide that another period of seven consecutive hours, between 10 pm and 7 am, shall replace the period specified above.
It is essential to attach the following documents to any request for an exemption from statutory public holidays:
- The opinion of the staff representatives, if the number of employees in your company justifies the presence of such representatives
Or - The opinion of the staff concerned, if the number of employees in your company does not justify the presence of staff representatives

- The CAR number of your company
- The name of your company
- The registered name of your company
- The address of your company
- The phone number of your company
- The staff affected by the request
- The circumstances justifying the request
- The period or date of the exemption
If you do not have staff representatives, please also specify the number of employees in your company.
You should send your request an exemption to night work for female employees, accompanied by the requested supporting documents, to the Labour Inspectorate (or by email inspectiondutravail@gouv.mc).
