Trusts or similar legal arrangements and their beneficial owners must be entered in a specific register known as the “Register of trusts” (RDT) with the Business Development Agency.
Understanding the process
Within the meaning of the Act no. 214 of 27 February 1936 on the revision of Act no. 207 of 12 July 1935 on trusts, as amended, trusts or similar legal arrangements and their beneficial owners must be entered in a specific register known as the "Register of trusts" (RDT) with the Business Development Agency, regarding:
- Any trust constituted or transferred in the Principality and administered by a trustee established or domiciled in the territory of the Principality
- Any trust or similar legal arrangement administered by a trustee (or a person occupying an equivalent function for similar legal arrangements), established or domiciled outside the European Union (*) who:
- Acquires a property in the Principality or
- Establishes a business relationship in the territory of the Principality
(*) Where these trustees or their equivalents are established or domiciled in more than one member state of the European Union, or where they establish multiple business relationships in the name of the trust or legal arrangement in more than one of these states, then the obligation to register in the Register of trusts is satisfied by notifying the Business Development Agency:
- A certificate providing proof of registration with the register of one of these states, or
- An extract from the information on beneficial owners held in the register of one of these states
If none of the above-mentioned supporting documents are provided, the T1 form (available to download from this page) must be completed in order to be entered in the Register of trusts.
The entry in the Register of trusts must be made within one month of:
- The creation or transfer of the trust in the Principality
- The acquisition of the property in the Principality or the establishment of the business relationship in the territory of the Principality
Any change to the information initially entered in the Register of trusts is subject to a supplementary or amended declaration.
The Business Development Agency must be notified of this declaration within one month of the change.
